To perform a nondisruptive upgrade, all nodes in the cluster must be running a version of clustered Data ONTAP that supports this functionality. Data ONTAP 8.2 is the first release that supports NDUs for Hyper-V over SMB solutions; therefore, nondisruptive upgrades are supported if all nodes in the cluster are running Data ONTAP 8.2 or later. This includes upgrades within the Data ONTAP 8.2 release family.
